This privacy policy provides information on how personal data is processed by airMont and in the "My Chimney" app. The terms "we," "us," and "airMont" refer to Airmont AS, with organization number 922 819 753. References to "you," "your," and "the data subject" refer to the individual about whom we process personal data. The term "the app" refers to the "My Chimney" app. airMont is the data controller for the information described in this privacy policy, and our contact details can be found at the end of this policy.

1.  Purpose and Legal Basis

1.1.   The "My Chimney" App

airMont offers the "My Chimney" app. Using the app is entirely voluntary. To access information and heating data from the app, the user must be registered with an address in the National Population Register, and the residence must have a Pipesensor installed. The purpose of processing personal data is to provide the app and offer users insights and guidance related to efficient, environmentally friendly, and safe heating.
 

The personal data processed to offer the app includes first name, last name, phone number, email address, physical address, login details (Bank-ID), date of birth, and personal identification number, unique user ID, and data collected from the Pipesensor (such as soot levels, burning times, and firing schedules). The date of birth and personal identification number are not stored but are only used to retrieve your registered address from the National Population Register.

Data collected from the Pipesensor is not considered personal data by itself, but it can reveal information about household activities, such as location and activity patterns (e.g., heating curves). This data will also be linked to your login information. Contact information may also be used to send notifications about chimney fires.
 

The legal basis for this processing is an agreement in accordance with GDPR Article 6(1)(b).

Please note that airMont is only responsible for collecting personal data to the extent that the user has granted permission by using the "My Chimney" app. The individual municipality is responsible for any other collection and use of heating data collected via the Pipesensor.

1.2.  Consent

The airMont Pipesensor collects heating data over time. This data is anonymized after 14 days and moved to midnight on the 1st of the current month. If you wish to view your data in real time, you can consent to us retaining the specific times for each heating event. This will also enable more accurate tracking and feedback from the app.

airMont also collaborates with research institutions such as the Norwegian Institute for Air Research (NILU) and SINTEF to focus on reducing air pollution and related health issues. If you would like to contribute to this type of research, you can consent to do so. Your heating data will be shared in a highly protected and anonymized manner, solely for research purposes. The data will not be shared for any other purpose, use, or motive without your updated consent.

All consents can easily be modified or withdrawn in the app’s settings.

 

 

1.3.  Household Members

If you live at an address where a Pipesensor is installed and another person in the household has started using the "My Chimney" service, we may process personal data (time-stamped heating data) related to the household. The data collected from the Pipesensor (such as soot levels, burning times, and firing schedules) may indirectly reveal information about the presence and activities of members of the household. While airMont does not have direct access to information about who resides in the household, this information could potentially be available through public sources or online registers.

The processing of household data, due to a household member granting permission for the collection of personal data via the Pipesensor, is based on our legitimate interest in providing a service aimed at ensuring efficient, environmentally friendly, and safe heating, in accordance with GDPR Article 6(1)(f).

1.4.  Error Logging and Monitoring

We use the error logging service Session Replay from Sentry to monitor a user session in order to detect errors, unusual behavior, and slow performance. This service is essential for our services to function properly and is automatically activated. The logged information includes text/data entered into text fields (which are redacted), as well as mouse clicks and movements within the app.

To the extent that personal data is processed, this is based on a legitimate interest in accordance with GDPR Article 6(1)(b). The legitimate interest is to ensure we can provide a secure and functioning app.The data and logs are stored for up to 90 days.

1.5  Agreements with Partners and Suppliers

airMont processes personal data of partners and suppliers for the purposes of contract management, service delivery, and service exchange. The personal data processed includes contact details such as names, phone numbers, addresses, and email addresses, as well as any relevant billing information. The legal basis for this processing is the contract the company has with individual partners and suppliers, where the contract is made directly with the individual whose personal data is being processed, in accordance with GDPR Article 6(1)(b). If the contract is made on behalf of a business entity, the legal basis is our legitimate interest in fulfilling the contractual relationship, in accordance with GDPR Article 6(1)(f).

 

  

2.  Recipients of Personal Data and Use of Subcontractors

airMont does not share your personal data with third parties unless such disclosure is required by legal obligations or we have another lawful basis for doing so.

We use subcontractors (data processors) for certain administrative tasks, including Microsoft for hosting the "My Chimney" service. In cases where we share data with a data processor, the processing of personal data is secured through data processing agreements. These agreements ensure that the personal data is not used for any other purpose and that the processing complies with GDPR requirements.

airMont processes certain personal data (time-stamped heating data) outside the EU/EEA, including in the USA. In such cases, the data transfer is based on the EU-US Data Privacy Framework or the EU Standard Contractual Clauses.

 

 

3.  The Data Subject's Rights

As a data subject, you have the right to contact us and request the following:

  • Correction, Access, and Deletion: You have the right to request a free copy of your personal data, to request the correction of inaccurate information, and, in certain circumstances, to request the deletion of your personal data.

  • Restriction:  You have the right to request that we limit the processing of your personal data under certain circumstances, such as while we investigate any objections you raise regarding our processing of your personal data.

  • Data Portability: In some cases, you have the right to data portability, meaning that you can request that we provide your data in a structured, commonly used, and machine-readable format so that you can transfer it to another data controller. This applies only if the processing is based on your consent or an agreement with you.

  • Objection: In certain situations, you have the right to object to our processing of your personal data. If you do so, we will stop processing your data unless we can demonstrate compelling legitimate grounds for continuing the processing.

  • Objection to Direct Marketing: You have the right to object to our direct marketing activities (including profiling for marketing purposes). We will then stop processing your personal data for these purposes.

  • TWithdrawal of Consent: If the processing of personal data is based on your consent, you have the right to withdraw your consent at any time. We will then stop any future processing of personal data that relies on your consent.

  • Complaint to the Data Protection Authority: You have the right to file a complaint with the Norwegian Data Protection Authority regarding the processing of your personal data. We appreciate it if you contact us directly first

 

4.  Retention Period

We process personal data as long as we have a legal basis for doing so. For example, we will retain your information for the duration of your agreement with us, such as for the use of the "My Chimney" service, and then delete it when you terminate the service or the contractual relationship.

If the basis is consent, airMont will retain personal data for as long as we have valid consent.

We will also retain personal data if we have a legal obligation to do so, such as under accounting or bookkeeping regulations.In certain cases, we may continue to process personal data beyond this period, for example, if it is necessary to establish, defend, or assert a legal claim.
